Xbox 360 Sales Ban for US Recommended by Judge

Original Story: Following up on a previous ruling, which deemed Microsoft in violation of Motorola WiFi and video codec patents, judge David Shaw has recommended against the continued sale of the Xbox 360 in the United States, according to MCV. Should Microsoft be deemed in infringement of existing patents, it would threaten the possibility of selling consoles using that tech.

"Enforcing intellectual property rights outweighs any potential economic impact on video game console buyers," said Shaw.

This movement isn't a decision, but it could influence the International Trade Commission's final decision in the case. If the ITC happens to agree with Shaw's call, the verdict will move up to the White House, where the decision to halt sales will be at the whim of President Barack Obama and his advisers.

With the Xbox 360 and Windows 7 having been banned in Germany this month, it's not a far cry to say Microsoft's infringement on Motorola Mobility's intellectual property could affect the States.

Microsoft argued to Shaw that a United States ban would be unfair to consumers, who would have limited options. Shaw declared Nintendo and Sony could pick up the slack.

We've reached out to Microsoft for a reaction, and will have more on this case as it draws to a close.

Fuck intellectual property law so god damned hard. I don't even own a 360, but this is absolutely absurd.

Oh dear, atleast Sony had some reason to improve the PS3 before.

What's actually wrong with the PS3 (other than Sony being a bunch of dicks about a bunch of stuff)?  I hadn't heard anything about stupidly broken hardware designs on it like the 360 has.

Most of the PS3's problems had to do with security. The PS3 was easily hacked into last year which caused the entire online service to be shut down for a good 2 months.

It was the online service. Apparently the guy potentially could have taken people's credit card information as well as their passwords.

It was the online service, although Sony (since they're being dicks about a bunch of stuff) took the opportunity to (ineffectively) lock down the console more as wel, and probably didn't do anything effective to protect the online service.

You know, it's times like this I really wish Sony didn't make such awesome and reliable hardware...

EVERYTHING they make except for the PS3 is, so far as I know (with the possible exception of their 3D tv sets), completely commoditified hardware.  You can buy an equivalent from ANYBODY who makes the same class of goods.  (And Sony hardware isn't always that reliable.  They made those lion battery cells that could spontaneously combust a few years back.)

Let's just say that neither me nor any other professional I've talked to has seen that with their cameras and lenses. You can debate whether or not Canon (say) is just as good, but it's definitely NOT rebranded.

Not to mention the PS3 has always lagged behind the Xbox 360 in terms of what it offered outside gaming (besides Blu-Ray.) Netflix, Hulu, Facebook, ESPN3*, and HBO GO* all debuted their console apps on Xbox first.

*=Still only on Xbox for consoles

That's weird, because Sony's Blu-Ray players have always been great about offering Netflix, Hulu, and all other sorts of services.

(Although I do wish they would update mine so I could plug in exFAT drives.)
